Abstract

Defensive jurisprudence basically consists of the adoption of practices by the Brazilian Superior Courts, for not knowing about appeals, maintaining the focus of the appeal analysis on the formality and rigidity of the admissibility and knowledge assumptions. Although the new Civil Procedure Code brought the Constitutionalization of Civil Procedure, trying to avoid the occurrence of what we call defensive jurisprudence, it is still common. Much of the hypotheses brought by the doctrine as defensive jurisprudence are no longer used, but the overload of the Judiciary brings, every day, new ways of its application.
