Abstract

This article begins with the análise of the foundations and objectives of the Constitutional Process, especially in its intertwining with the realization of fundamental rights.  Next, we investigate the relations between the Constitutional Process and constitutional jurisdition, emphasizing the greater breadth of the first and the subordination of the second to its general purposes. We will then problematize the constitutional jurisdiction in Brazil, especially in light of the strengthening of the abstract mode of repressive control, as well as the deviations that such centralization has meaning. Finally, we will discuss the adoption of institutes  of the decision-making stare in a system of Roman-Germanic tradition, highlighting that, to be wholesome, contributions like this must be paulatine and in-depth.
