Abstract

This paper explores how digital structures can facilitate anticompetitive conduct. It suggests that the structure of these markets can enable new manifestations of anti-competitive practices, so that some traditional premises of competition law may not be suited to the identification of unilateral abusive conduct in the digital market. The methodology used in the construction of the work, regarding the procedure, consists of bibliographic review, as well as the analysis of a CADE’s decision regarding “Google Shopping” case. At first, it were addressed some characteristics of digital markets and relationships. On a continuous basis, some important conceptual delimitations, as well as the way in which the abuse of dominant position is more frequent in digital markets from a perspective of the consolidation of economic power in digital structures. Finally, an analysis of CADE's decision was carried out, which pointed to the need to rethink concepts in the review of anti-competitive conducts in digital markets.
