IN SEARCH OF THE ADEQUATE WAY TO RESOLVE STRUCTURAL DISPUTES IN THE LIGHT OF THE DEMOCRATIC STATE OF LAW

Abstract

Considering the presence, in contemporary society, increasingly expressive of structural disputes characterized by multipolarity, complexity and conflict, it becomes necessary to seek the most appropriate way to resolve such conflicts, which is, therefore, the objective of the present work. The research is justified in view of the importance that the law remains sensitive to changes in society and is able to adequately resolve existing conflicts. In order to do so, it was firts approached the introductory notions about structural disputes and, later, expose the five possible ways of dealing with such conflicts. The deductive method was used from the bibliographic review of important national scholars, documental research through the examination of legislative documents of the Brazilian legal system, as well as research in primary source. In the course of the work, it was found that the term of conduct adjustment has greater potential to resolve structural disputes when compared to the other alternatives.
