OS THE FUNDAMENTAL RIGHTS OF HUMANITY AND PERSONALITY IN THE APPLICATION AND EXECUTION OF PENALTIES

Abstract

The present study starts from a brief analysis of the history of applicable penalties and the historical and social movements that resulted in new principles and new laws regarding penalties and the rights of the condemned. It investigates the importance of the principles of humanity and the personality of penalties in the light of the Federal Constitution and, after that, a study is made of the penalties currently provided for in the Brazilian infra-constitutional legislation. The recognition of the Unconstitutional State of Things in the Brazilian prison system reveals the need to implement effective public policies capable of extirpating or, at least, alleviating the generalized violation of human rights in prisons. Present in national legislation and in numerous international treaties, the observance and application of these constitutional principles and respect for human and fundamental rights in concrete cases and in practice are imperative, bringing with them challenges regarding the analysis, judgment, execution and supervision of the penalty and its effectiveness, always in compliance with the rights and guarantees of the person in the Constitutional State of Law.
