Abstract

This article aims to analyze the applicability of alternative methods of conflict resolution within Family Holdings. For this purpose, doctrinal research will be used in order to consolidate the reasoning. Encouraging the legislator to use, whenever possible, alternative dispute resolution methods is an important step towards improving the Judiciary and seeking to satisfy stakeholders. Within Business Law, in view of the large number of family businesses and the tendency to form Family Holdings, mediation and arbitration can be important allies in the continuity of business activities. The research used the approach based on the deductive method, starting from general premises to, from them, reach particular conclusions. It concludes by the necessary propagation of the importance of these jurisdictional equivalents for the resolution of conflicts in Family Holdings.

Natália Murad do Prado Schmidt, FUMEC

Graduated in Law from the Faculty of Law of Varginha (2006). He is currently the Public Records Officer-Court of Justice of the State of Bahia. He has experience in the field of Law, with an emphasis on Family Law, Notary and Registry and Civil Law. Master's student at Universidade Fernano Pessoa/PT and Universidade FUMEC/BR.

Doutor (2019) e Mestre (2009) pela Faculdade de Direito da Universidade Federal de Minas Gerais (UFMG). Diplomado no Curso de Relações Internacionais do Instituto Legislativo Brasileiro (Senado Federal).
