A DOGMÁTICA JURÍDICA E A ORIGEM DO TRIBUNAL DO JÚRI DO BRASIL
UMA ANÁLISE A PARTIR DO RACIONALISMO CRÍTICO DE KARL POPPER

The present article questions, as a research problem, what would be the historical assumptions for the institution of the jury court in the Brazilian legal system and whether if those assumptions justify continuation of the trial by jury. To this end, this study, through the hypothetical-deductive method and bibliographic research, adopting Karl Popper’s critical rationalism as its theoretical framework, has the general objective of researching the historical assumptions of the institution of the trial by jury in Brazil and its possible conservation. It is conjectured, as a research hypothesis, that the maintenance of these assumptions, reflecting the mistaken ideal according to which the judicial decision formalized by juries would be democratic insofar as it should represent the popular will. The study leads to the conclusion that the perpetuation of the jury trial in Brazilian legal system is based on the absence of problematization of the assumption that the democratic of the trial is associated with the subject that pronounces the judicial decision.
