Abstract

The system of division of legislative competences on environmental issues established by the Federal Constitution of 1988 aimed to ensure a sphere of legislative autonomy to the federated entities through a mechanism of concurrent competence. This article intends to investigate the possibility of states and municipalities introducing protective systems which could be more rigid in relation to the general norms. Therefore, a study is proposed on decisions of the Supreme Federal Court involving possible conflicts of legislative competence between different federated entities. As a hypothesis, it is suggested that there is a reduced autonomy regarding supplementary competence, which is harming the sphere of legislative initiative of the states and municipalities to reinforce the protective norms.
