ONLINE DISPUTE RESOLUTION AND ONLINE MEDIATION IN FAMILY LAW

A CRITICAL ANALYSIS OF PROCEDURAL LIMITS

Abstract

The incorporation of Online Dispute Resolution (ODR) systems into the justice system has expanded the use of online mediation as a consensual mechanism for dispute resolution. In the field of Family Law, however, the application of such mechanisms requires caution due to the specific characteristics that define these types of conflicts. This article provides a critical analysis of online mediation as a form of ODR within the multi-door courthouse system, examining its procedural limits and the risks associated with its indiscriminate use. To this end, the study adopts a qualitative methodological approach, based on bibliographic review and documentary analysis of legal sources and empirical studies on online mediation and ODR. It argues that the effectiveness of online mediation in family disputes depends on the adoption of adequacy criteria and procedures that are sensitive to the vulnerabilities involved.
