A PRE-PROCEDURAL MEDIATION AS A REQUIREMENT FOR FAMILY LAW ACTIONS

Abstract

The growing complexity of family conflicts in the contemporary context has revealed the limitations of Brazil’s traditional procedural model in adequately addressing disputes that transcend purely legal issues. This study examines the legal, empirical, and comparative foundations supporting the need to establish mandatory pre-procedural mediation for family law actions in Brazil. The research employed bibliographic methodology, document analysis, and empirical data analysis from pioneering Brazilian courts. The study analyzes the historical evolution of Family Law, demonstrating the inadequacy of the traditional adversarial model for conflicts involving permanent bonds and emotional complexities inherent in family relationships. Empirical results show that pre-procedural mediation achieves agreement rates of 85-92%, substantially higher than procedural mediation (70%), with the Federal District Court of Justice preventing 4,194 new lawsuits in the first half of 2024. The research demonstrates that the phenomenon of perpetual litigation in the Brazilian Judiciary, evidenced by 83.9 million pending cases in 2023 and 80.6 million in 2024, a year in which 39.4 million new cases were filed, demands urgent paradigmatic transformation. International experience, particularly the Argentine model established over fifteen years ago, demonstrates the practical feasibility of mandatory requirements in similar legal systems. Brazil’s regulatory framework, established through CNJ Resolution No. 125/2010, the Mediation Law, and the 2015 Civil Procedure Code, already shows clear legislative preference for consensual methods in family actions. Mandatory pre-procedural mediation represents a structural solution to the family litigation crisis, contributing to the preservation of essential bonds and promoting a culture of peace in Brazilian families.
