AS REGRAS DOGMÁTICAS DA INTERPRETAÇÃO JURISPRUDENCIAL DO DIREITO

This article seeks to problematize the traditional conception of Law as a dogmatic science, based on the incompatibility of this conception with the project of building a Democratic State of Law. By examining the concept of legal dogmatics, it critiques the manipulation of norms by judges, consolidating them as the sole privileged interpreters of the legal order. Drawing on Karl Popper's critique of the inductive method and Rosemiro Pereira Leal's Neoinstitutional Procedural Theory of Law, the article highlights the obstacles to democracy posed by the strengthening of the Dogmatic Science of Law. For this study, bibliographic research and the hypothetical-deductive method will also be employed, starting from a macro perspective towards a micro-analytical conception of the controversial point under study. Finally, thematic, theoretical, and interpretative analysis will be used as a technical procedure, aiming to suggest a solution to the highlighted issue.
