ACCESS TO JUSTICE AND CONDUCT ADJUSTMENT TERM:

ANALYSIS IN THE BRAZILIAN AND INTERNATIONAL FRAMEWORK FROM THE VIEW OF PERSONAL RIGHTS

Abstract

The article proposes to analyze the access to justice in the vision of Cappelletti and Garth, and the Term of Adjustment of Conduct - TAC, in the national and international field - collective agreement -, starting from a bibliographic analysis made on comparative law, in particular with the US model (class actions) and the European model. The effectiveness of the TAC in the national field is also discussed, verifying whether the term can be effective in protecting diffuse and collective rights, as well as ensuring the rights of the personality, which will be the specific objectives to be achieved by the research. The present research has as a problem whether the TAC can be effective in accessing justice and in the protection of personality rights, and as a general objective of access to justice and the TAC as an instrument (or not) of the protection of personality rights. For that, the hypothetical-deductive method and the bibliographic review technique will be used.
