CONVENTIONALITY CONTROL AND THE SOCIAL VALUE OF WORK IN THE LIGHT OF CONVENTION 158 OF THE INTERNATIONAL LABOR ORGANIZATION
Abstract
Abstract: Summary: the study aims to analyze the denunciation of Convention No. 158 of the International Labor Organization (ILO) by the Brazilian State, through a case study. The hypothetical-deductive method was applied, using bibliographical research and legal norms, whose theoretical framework is Jürgen Habermas. The Convention was approved at the 68th Meeting of the International Labor Conference, on January 2, 1982. In 1985, it came into force throughout Brazilian territory, regulating dismissal without just cause. After 11 months of its ratification, it was denounced by President Fernando Henrique Cardoso. Unilaterally, through Presidential Decree No. 2,100/1996, the provisions contained in the International Treaty were revoked. For this reason, the National Confederation of Agricultural Workers (Contag) and the Central Única dos Trabalhadores (CUT) filed Direct Unconstitutionality Action (ADI) No. 1,625, which claimed the unconstitutionality of the presidential decree, causing a violation of art. 49, item I, of the Federal Constitution. Employer unions also appealed to the Judiciary through Direct Constitutional Action (ADC) No. 39, calling for the constitutionality of the presidential decree, based on art. 84 of the Federal Constitution. In 2023, the STF ministers, by majority vote, declared the constitutionality of the Presidential Decree, pacifying Brazil's withdrawal from compliance with ILO Convention No. 158. Jurists and scholars of political legal philosophy disagree about the premises that supported the STF's decision. By addressing such axioms, this work demonstrates the importance of ILO conventions for the observance of universal concepts of human dignity and the social value of work. It is in this context that the need and legal and social importance of ILO standards must be understood .
