THE ATYPICAL PROCEDURAL TRANSACTION AS AN INSTRUMENT FOR IMPLEMENTING THE CONCILIATION POLICY

Abstract

The general objective of this study was to analyze the problem of the correlation between the consensual approach introduced into the Brazilian legal system by Resolution No. 125/2010/CNJ, which consolidated the National Judicial Policy for the appropriate treatment of conflicts of interest, and the atypical procedural agreement established by Article 190 of the 2015 Code of Civil Procedure. The justification was found in the observation that the favorable legal and social impact promoted by the consensual approach to litigation should be equally sought for procedural agreements, since cooperation between the parties to the lawsuit, aiming at adapting the procedure to the specificities of each conflict, in addition to providing greater effectiveness to the process, increases the probability of agreements on the merits of the case being judged. As specific objectives, this work aimed to (i) address the paradigmatic shift in consensus brought about by Resolution No. 125/2010/CNJ; (ii) analyze the atypical procedural agreement authorized by the 2015 Code of Civil Procedure; (iii) affirm the atypical procedural agreement as a conciliation mechanism that meets the national judicial policy of adequate treatment of conflicts of interest and the principle of access to justice in the sense of achieving a just legal order and effective solutions.The conclusion reached was that the national judicial policy for the appropriate treatment of conflicts of interest still neglects procedural matters, deserving to be reviewed in this regard in order to fully meet its intended purposes. The theoretical framework was the theory of constitutional procedure, developed by José Alfredo de Oliveira Baracho. The method adopted was deductive for logical construction, starting from general principle premises to obtain specific conclusions.
